In a significant move, Immigration, Refugees and Citizenship Canada (IRCC) has introduced a temporary policy enabling specific PNP candidates now eligible to apply for an open work permit (OWP). This temporary measure opens up more employment opportunities for provincial nominees, allowing them to work for any employer in Canada while awaiting permanent residency.

This policy provides relief for eligible individuals with a job offer, a valid work permit, or even those whose work permits expired after May 7, 2024. Applicants must also have a support letter from their province or territory verifying their placement in an Expression of Interest pool or an ongoing application assessment.

This policy will be effective from August 11, 2024, and will continue until December 31, 2024, unless IRCC decides to revoke it earlier without prior notice.

Who Qualifies for This Policy?

Scenario 1: Applicants With Active Work Permits

You may apply for an open work permit if you currently hold a valid work permit and fall under the Provincial Nominee Program (PNP). However, you need to meet these conditions:

  1. Submit a New Work Permit Application: This application must be made under Section 200 of Canada’s Immigration and Refugee Protection Regulations.
  2. Provide Required Documents:
    • A support letter from your province or territory confirming your placement in their Expression of Interest pool or inventory process.
    • A valid job offer from your current employer.

Scenario 2: Work Permit Expired After May 7, 2024

If your work permit expires after May 7, 2024, you still qualify to apply under this policy. You must:

  1. Apply for a New Work Permit: This should also be under Section 200.
  2. Request Temporary Resident Status: You’ll need to apply for either an extension or restoration of your temporary resident status under Sections 181 and 182, respectively.
  3. Submit Supporting Documents:
    • A support letter from the relevant authority confirming your participation in the provincial application pool.
    • A job offer from your current employer.

Scenario 3: Pending Work Permit Extension

If your work permit extension is approved or pending, and you held authorization to work on May 7, 2024, you also qualify under this policy. The steps include:

  1. Apply for a New Permit: Submit this application under Section 200 of the Regulations.
  2. Request Extension of Status: Apply for an extension of your temporary resident status.
  3. Provide Supporting Documents:
    • A support letter from the province or territory confirming your status in their Expression of Interest pool.
    • A job offer from your employer.

Why IRCC Implemented This Policy:

IRCC introduced this policy to ease the transition of temporary residents into permanent residency through Provincial Nominee Programs (PNPs). Many of these candidates have already demonstrated their value to Canada’s labor market, which helps to ensure that they remain in the country while their applications are processed.

The Canadian government views this approach as a way to support the provinces and territories in retaining talent. It then further contributes to their local economies who also seeks to adjust the ratio between temporary and permanent residents.
